ORGANIZATION FOR THE PROTECTION OF THE RIGHTS OF INSURED PATIENTS IN THE SYSTEM OF OBLIGATORY MEDICAL INSURANCE

Abstract

In accordance with the Federal law «About obligatory medical insurance in the Russian Federation» insured patients in system of obligatory medical insurance have the right to protection of their rights and legal interests. However, there are certain legal and institutional challenges to the implementation of this right by insured ones. This is the problem of ensuring the independence of the expert and judicial bodies, and the impossibility, in some cases, to provide compensation to the insured patient. To solve these problems, the article proposes the creation of a new independent expert and arbitration of the judiciary amendments to existing legislation to facilitate the approval of the insured ones’ rights in these official bodies.
